These terms govern your use of bowriverdigital.ca (the "site"), which is operated by Bow River Digital ("we", "us"). By using the site you agree to them. If you do not agree, please do not use the site.

1. What these terms cover

These terms cover this website only. They are not the contract for any design, development, marketing, or hosting work we do for you. That work is governed by the written proposal, statement of work, or services agreement we sign with you, which takes precedence over anything on this page if the two conflict.

2. Information on the site

Content on this site — including service descriptions, pricing, timelines, and portfolio examples — is provided for general information. It is not a quote, an offer, or professional advice, and it may change without notice. Pricing shown on the pricing page is indicative and is confirmed only in a written proposal.

3. Acceptable use

You agree not to:

• use the site for any unlawful purpose, or in breach of any applicable law or regulation;
• attempt to gain unauthorized access to the site, its servers, or any connected system;
• interfere with, disrupt, or place unreasonable load on the site, including through scraping, automated bulk requests, or denial-of-service activity;
• submit false, misleading, or abusive content through the contact form, or use it to send unsolicited commercial messages; or
• copy, reproduce, or republish site content except as permitted below.

4. Intellectual property

The site and its content — including text, layout, graphics, code, and the Bow River Digital name and branding — are owned by us or our licensors and are protected by copyright and trademark law. You may view the site and print or save pages for your own reference. You may not otherwise reproduce, distribute, or create derivative works from site content without our written permission.

Ownership of work we produce for a client — including source code, design files, and content — is set out in the applicable client agreement.

Portfolio examples, client names, and logos shown on this site remain the property of their respective owners and are displayed to describe work we have performed.

5. Third-party links and services

The site links to third-party websites and loads resources from third parties, including Google Fonts and Google Analytics. We do not control those services and are not responsible for their content, availability, or privacy practices. Links do not imply endorsement. See our Privacy Policy for how third parties are used.

6. Availability

We aim to keep the site available and accurate, but we do not warrant that it will be uninterrupted, error-free, or free of harmful components. We may change, suspend, or withdraw any part of the site at any time.

7. Limitation of liability

To the fullest extent permitted by law, the site is provided "as is" and we make no warranties of any kind, express or implied, regarding it. We will not be liable for any indirect, incidental, special, or consequential losses, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the site.

Nothing in these terms excludes or limits any liability that cannot lawfully be excluded or limited, including under Alberta consumer protection legislation where it applies.

We may update these terms from time to time. The version in force is the one published on this page, with the date shown at the top. Continued use of the site after a change means you accept the updated terms.

9. Governing law

These terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable in Alberta. You agree to the exclusive jurisdiction of the courts of Alberta, sitting in Calgary, for any dispute arising from these terms or your use of the site.
